This Mobile App Privacy Policy (this “Mobile Privacy Policy”) describes how your personal information is collected, used, processed, and shared by The Litas (“The Litas”, “us”, or “we”) when you register with or subscribe to our collective mobile application, including through the application’s features, content, orders, and event services (collectively, the “App”). When you use the App, we are generally the controller of personal information we collect, and we will use and process your information in accordance with this Mobile Privacy Policy.
PLEASE READ THIS MOBILE PRIVACY POLICY CAREFULLY BEFORE USING OR SUBSCRIBING TO THE APPLICATION. THIS MOBILE PRIVACY POLICY DOES NOT APPLY TO INFORMATION THAT WE (A) COLLECT OFFLINE OR ON ANY OF OUR WEBSITES; OR (B) LAWFULLY RECEIVE FROM OUR THIRD-PARTY SERVICE PROVIDERS OR PROCESSORS.
1. Personal Information We Collect on the App
We may collect information from you, as an end user of the App, when: (A) you provide it directly to us through the App’s features and services, including online registration of an account; and (B) when the App automatically gathers information from your mobile device during your use of the App.
Information you provide to us. When you download, register with, or interact with the App, we may ask you to provide the following information directly to us: (i) personally identifying information, including name, postal address, email address, and phone number; (ii) payment information (including credit card numbers); (iii) characteristics or descriptions that can be used to identify you, including messages, comments, photos, social media posts, or feedback on the App’s features and Litas gatherings and events; and (iv) non-personal information that cannot be used to identify you, such as the make, model, and year of your motorcycle.
Automatic information collection. When you download, access, and use the App on your mobile device, the App may use technology to automatically collect: (i) usage details, including traffic and location data; (ii) device information, including unique identifiers, operating system, mobile network information, and phone number; (iii) stored information and files, such as photographs, audio and video clips, and personal contacts; and (iv) location information.
You are not required to provide personal information to The Litas through the App. However, if you do not provide us with information, you may not be able to use certain features of the App or join in our network of moto-related events. In general, we do not collect information that is considered sensitive under data protection laws, such as social security number or other government‑issued ID numbers.
2. How Do We Use Your Personal Information?
We may use the information that we collect through the App to:
Communicate directly with you concerning your use of the App;
Monitor and record your participation in our events and network to ensure compliance with The Litas’ standards and safety procedures;
Perform our contractual obligations to you in order to complete orders of our products and services, including delivery of any orders of personalized Litas’ products;
Operate, maintain, and provide features of the App to you; and
When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services available through the App.
In addition, we may use your automatically collected device information to help us screen for potential risk and fraud on the App, and more generally, to improve and optimize our App for our end users (for example, by generating analytics about how our Lita members browse and interact with the App and Litas-designed events and offerings).
3. Sharing Your Personal Information
We may share your personal information with third parties (including processors and services providers acting on our behalf) to help us meet our contractual obligations with you and to provide the App and its content and services to you. In addition, we may share your personal information with your local branch representatives to assist them in complying with applicable laws, running Litas events, and confirming your compliance with The Litas’ safety standards.
We may also share your personal information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights (both at law and under contractual arrangements).
During the ongoing operations of The Litas, we may sell and transfer to third parties your information that we have anonymized in a manner that no longer identifies you, doing so without any additional notice to you given the nature of the anonymized information. Moreover, we may sell to and share with third parties and other businesses, in our discretion, non-personal information we gather through the App (e.g., the make, model, and year of your motorcycle) to further support our services and the legitimate interests of The Litas.
4. Storage of Your Information & Retention
To support our App and events scheduled through the App, The Litas may collect, store, and process your personal information on our premises, data platforms, and private cloud storage solutions in the United States. The transfer or disclosure of your personal information to our U.S. systems, if you reside outside the United States, is necessary to fulfill the orders you make on the App and to enable The Litas and our service providers to give essential support to the App and you, as an end user.
We retain your personal information for a reasonable period to fulfill the purposes for which we collected it (as outlined in this Mobile Privacy Policy), including to defend our rights under product sales and orders with you and in relation to Litas events. If we no longer reasonably need your information for such purposes, we will, at our election and in accordance with applicable data protection laws, delete it from our records, anonymize the information, or archive the information in a manner consistent with industry standards for protection and retention of personal information.
5. Your Rights
Pursuant to applicable data protection laws, you may contact The Litas to request the exercise of certain rights concerning your personal information, including the right to:
Erase or delete your personal information.
Access your personal information.
Restrict the processing of your personal information.
Correct, update, or rectify your personal information.
Receive a copy of your personal information (data portability).
Object to the processing of your personal information.
Withdraw consent to the processing of your personal information, if we relied on your consent to collect and process your personal information.
In addition, you may also have the right to: (A) request that we disclose the categories and specific pieces of personal information we have collected and disclosed about you; (B) know whether we have sold your personal information; (C) request information about our disclosure of personal information to third parties and our service providers, including for their direct marketing purposes; and (D) opt-out of The Litas sharing your personal information with third parties and our service providers. You also have the right to lodge a complaint with a supervisory authority. Depending on where you are located, some of these rights may not apply or may be subject to limitations. For example, we may limit the number of requests you make or charge reasonable fees as legally permitted. YOU WILL NOT FACE DISCRIMINATION FOR EXERCISING YOUR RIGHTS WITH RESPECT TO YOUR PERSONAL INFORMATION.

6. Children’s Privacy
The App is not intended for children under eighteen (18) years of age, and we do not knowingly collect personal information from persons under eighteen (18). In general, the primary use of the App is to assist our members with coordinating meetups and events with respect to motorcycle riding—activities which, subject to applicable laws, are not appropriate for under‑aged persons. If you believe we might have information from or about a child, please immediately contact us at the information set out below.
7. Changes & Updates
We may update this Mobile Privacy Policy from time to time in order to reflect changes to our practices and Litas event standards or for other operational, legal, or regulatory reasons. We will update the “last updated” date above to reflect the date on which we adopt any changes.
